Luca Lupària Donati


Luca Lupària Donati is Full Professor of Criminal Procedure and he also teaches Corporate Criminal Law and Procedure. He is a criminal lawyer at the Court of Milan, admitted to the Court of Cassation and the other Higher Courts.

He graduated in Law at the University of Milan (magna cum laude) and obtained his PhD in Criminal Procedure at the University of Bologna Alma Mater Studiorum. He is Visiting Professor at primary European and American Universities (among which, Paris Sorbonne, Paris Nanterre, Cincinnati, Medellin, Poitiers, Salamanca, Seville, etc).

Member of the editorial boards of international law reviews (among which, Law Probability and Risk, by the Oxford University Press), he is part of the directive committees of eminent Italian and international law journals. He is co-director of three editorial series and he is vice director of the law journal Sistema Penale.

For several years now, he has been working – as criminal lawyer – on criminal law applied to economics, with special reference to corporate, bank, tax, and bankruptcy crimes, as well as criminal offences against the Public Administration, safe and security, IT and cybercrimes. In these contexts, he has recognized position, also thanks to the relevance – often at international level – of the judicial cases he deals with.

Main area of his practice is the corporate criminal liability pursuant to Legislative Decree no 231/2001, and counseling on corporate management and organizational models, also in favor of multinational and listed companies.

He is Member of the International Association of Lawyers, and he is the founder of Lupària Law Firm (Studio Legale Lupària). In March 2021, he has been appointed by the Italian Ministry of Justice, as member of the Commission for the Reformation of the Italian Criminal System (“Commissione Lattanzi”). He has been in charge of international research projects (especially on victims of crimes), also financed by the European Commission.

He has been, and he is currently, President of Supervisory Board of primary corporations, also publicly-controlled, listed, or holding of international groups. He is President of various International Supervisory Boards 231.

He is the author of several monographs on the core issues of criminal justice, and of over 200 scientific publications, that were published also abroad, on foreign law-journals and international volumes. He works with law-reviews both Italian and European.

He is member of, among others, of the Center for Advanced Studies of Process and Justice, the Deutsch-Italienischen Zentrum für europäische Exzellenz, as well as membre corréspondant of the Comité international des pénalistes francophones and of the Société de législation comparée, of the AIDP, of ICON-Italy. He is the Scientific Director of the Italian Criminal Justice Festival, and he is member of the Associazione degli Organismi di Vigilanza (AODV).
